TERMS & CONDITIONS
The present Terms and Conditions (hereinafter “Terms and Conditions”) regulate the use of the Mojobrands website, accessible from www.mojobrands.net (hereinafter “Mojobrands website”).
This website is owned and managed by Mojobrands Lifestyle, Lda (hereinafter Mojobrands), as the controller, with tax ID number 509 283 446 and head office at Rua Roberto Ivens, nº1280 – Room 12, 4450-251 Matosinhos, is the legitimate and exclusive owner of the Mojobrands website.
The use of the Mojobrands website by clients (hereinafter “Client”) or users (“hereinafter “User”) implies and entails the Client’s and User’s knowledge and acceptance of these Terms and Conditions.
The Client and the User declare that they possess the necessary legal capacity to accept the present Terms and Conditions.
Mojobrands reserves the right to amend these Terms and conditions, freely and at any time.
Freedom of Use
Provided that you comply with these Terms and Conditions and the applicable legislation, in particular the protection of copyright and intellectual property rights and criminal laws, you and the User are free to use the Mojobrands website.
The Client and the User are solely responsible for the use they make of all the content available on or accessed from the Mojobrands website, in accordance with these Terms and Conditions.
The following activities are in particular expressly prohibited:
(i) carrying out illegal activities or activities that violate the rights of Mojobrands or of its Customers and Users or of other Internet users;
(ii) using an identity other than the Customer or User or falsifying or concealing in any way the identity of the Customer or User in electronic mail messages or in any other Internet service;
(iii) producing or reproducing content that is offensive, defamatory or likely to violate the privacy or any other third party’s rights;
(iv) produce or reproduce texts, data, images or programs with illicit, racist, profane, pornographic, or obscene content, or that, in any way, may violate human rights or infringe the legislation in force;
(v) transmit, reproduce, advertise the sale, offer, exchange or demand for any copy or obtain a copy or use any copy of a computer program, musical work, videogram, written publication or any other work protected by copyright or intellectual property law, or any other material or information that may be legally protected or infringes the rights of third parties, regardless of the medium used, without holding the respective rights of transmission, reproduction, advertising, use or legally required authorization;
(vi) interfere with or condition in any way the use of the Mojobrands website or violate any rules, regulations or standards of the networks connected to the use of the Mojobrands website;
(vii) introduce, transmit or make accessible in any form material that contains viruses, programs, systems or files that destroy or limit the functionality and/or capability of any computer, including software and hardware or electronic communications equipment;
(viii) promoting or providing information about illegal activities, such as physical harm to other individuals or acts of cruelty to animals.
Violation of the Terms and Conditions
Mojobrands reserves the right to adopt all the measures it deems necessary to safeguard its rights in case of violation or attempted violation of these Terms, and may choose to suspend or block access and use of the website Mojobrands, with no right for the Customer or User to any compensation or indemnity as a result of such fact.
Exclusion of Liability
The entire content of the website Mojobrands, including, but not limited to, text, graphics, images, sounds, logos, trademarks, domains and any other elements, is owned by Mojobrands, which holds, in particular, all copyright and intellectual property rights, with the exception of content provided by customers or business partners who are identified as such. The protection of the Mojobrands content extends to all reproductions or copies, obtained from the content of the Mojobrands website.
The data of the Client or User may circulate on the network at the risk of being seen or used by unauthorized third parties. Mojobrands is not responsible for any losses or damages, direct or indirect, suffered by any Client or User, regarding the information contained on the website Mojobrands, or resulting from the use that the Client or User makes of the website Mojobrands, in particular for losses or modifications of the Client’s or User’s information; Mojobrands does not guarantee the confidentiality and privacy of any information sent by the Client or the User whenever it is transmitted over the Internet without additional security measures.
Access to and use of the Mojobrands website are subject to interferences, interruptions, disconnections or other anomalies, namely as a result of breakdowns, overloads, line loads or other eventualities to which Mojobrands is oblivious, with the Client and the User expressly recognizing that no responsibility may be charged to Mojobrands for damages, potential or actual that, directly or indirectly, may be suffered by the Client or the user as a result of the above-mentioned events.
Mojobrands does not guarantee that the Mojobrands website will function uninterruptedly or that is free of errors, viruses or other harmful elements.
Mojobrands is not responsible for any defects, incorrect operation or incompatibility, particularly with the hardware of the Clients or Users, and is not obliged to provide support in the use of the Mojobrands website, nor guarantee that it meets the purposes intended by the Client or User.
Mojobrands reserves the right, at any time, to add, delete or modify any content of the Mojobrands website.
Mojobrands reserves the right to prevent the access and use of the website Mojobrands to any Customers or Users who violate any part of these Terms and Conditions or any legal standards, particularly with regard to the use of the Internet and its users.
Mojobrands is not responsible for the accuracy, quality, safety, legality or lawfulness, including compliance with the rules concerning copyright and related rights, regarding the content, products or services on the website that have been provided by customer or business partners, as well as for any information found on third-party websites to which the Mojobrands website links.
Mojobrands is also not responsible for any acts or omissions of those third parties concerning those contents, products or services, and does not guarantee that those products or services will deliver the results intended by the Client or the User.
Mojobrands bears no responsibility for any consequences resulting from access by Clients or Users to third-party websites through links provided by Mojobrands.
Client or User Responsibility
The Client or the User is the only and exclusively responsible for the use he/she makes of the Mojobrands website, so it is bound to respect the applicable legislation, namely the Code of Copyright and Related Rights, the Code of Industrial Property and the and the Law of Computer Crime, as well as to act in good faith and to make use that does not offend any third party rights, in particular the right of personal portrayal, the right to personal reputation, the right to honor and privacy, as well as it does not constitute an attack on the grounds of race, nationality, ethnic origin, religion, political conviction or sex, that does not constitute defamation, incitement to fraud, violence, terrorism, sadism, prostitution, pedophilia, and does not use obscene, indecent or pornographic content in any way.
The Client or the User is authorized to make use of the content of the website Mojobrands only and exclusively for the purposes for which they are intended, being expressly forbidden to reproduce, publish or publicly disclose, distribute or otherwise make the content accessible to third parties by any other form, make the content accessible to third parties for purposes of public communication or marketing, being also forbidden to make any changes to the content.
It is also expressly forbidden for the Client or the User to create or introduce on the Mojobrands website any type of virus or programs that may damage or contaminate it, or to advise third parties to do so.
The Client or the User is bound not to invade the privacy of other Users or Clients of the Mojobrands Website, undertaking, in particular, not to send unsolicited messages, not to collect, treat or communicate personal data without the consent of its holder and not to send false or misleading messages or that violate any legal regulation in effect.
The Client or the User is solely responsible for any damages, direct or indirect, caused to himself, to Mojobrands or to any third party, related to the use of the Website Mojobrands, undertaking to proceed to pay the compensation that may be awarded as a result of any action, claim or conviction to which it may originate.
Social Media
The terms and conditions described extend to the social media used by Mojobrands: Facebook, Instagram, LinkedIn, Vimeo, Youtube and Behance.
Personal Data
The Client or the User hereby consents to the collection and computer treatment of their data, when applicable, authorizing Mojobrands to enter this data into a database.
The data controller is Mojobrands. The personal data provided by the Client or User are intended for the management of Mojobrands customers as well as Mojobrands’ marketing actions. Under Law No. 67/98 of 26 October, the Clients and Users are guaranteed access to their data and may request in writing its updating, correction or elimination, as well as the right, at any time, to request that their data not be used for Mojobrands’ marketing actions.
